female has possible back, neck, and head injuries. She (26 year old) was also
treated at the scene by SHAES, and transported to South Haven Community Hospital
ER.
Drug-Alcohol Involvement: It is believed that driver
#1 was under the influence of prescription drugs at the time of the crash.
Information:
Sheriff Dale R. Gribler reports that deputies responded to a 2 car personal
injury crash on CR-689 north of M-43. Through their investigation, deputies
determined that vehicle #1 was traveling North on CR-689, and crossed the center
line into the South-bound lane. Vehicle #2 was South-bound and attempted to
avoid a head-on collision by going off the west side of the road. Vehicle #1
then struck the driver side of vehicle #2. Driver #1 advised that he blacked
out, and admitted to taking 3mg of Atavan and 15mg of Percoset within 2 to 3
hours of the crash.
Law
Enforcement Action Taken:
This case is being investigated as an Operating Under the
Influence of Drugs related crash. A report will be submitted to the Van Buren
County Prosecutor's Office for charges in this incident after the investigation
is completed.

pending the completion of the traffic crash reconstruction and VBC
Prosecutor review.
Information:
Sheriff Dale R. Gribler reports that deputies
were dispatched to County Road 380 and 72nd St reference an unknown possible
personal injury accident.
Upon arrival deputies located a male subject who had
been thrown from the crashed vehicle as it had rolled repeatedly from the
initial impact site. As deputies treated the passenger by giving him CPR, he
began loose a pulse and stopped breathing. The passenger identified as Jaylin
“Kyree” Hatter, later lost his life due to the trauma sustained during the
crash.
Two other passengers, whose names are being with held
at this time, were treated at the scene by members of the South Haven Area
Community Services Fire/EMS. They were both later transported and treated at
South Haven Hospital for injuries sustained. Their injuries do not appear to be
life threatening at this time.
Van Buren County Sheriff’s Office Accident
Reconstruction Deputies then began the investigation in the traffic crash.
Through an investigation, that is still ongoing, it appears that the
driver of the vehicle was attempting to pass another vehicle upon CR 380 and
drove off the paved portion of the roadway. The driver then over corrected the
vehicle, which began to turn the vehicle sideways, and crash into the ditch
embankment along the roadway. The vehicle then began to roll over numerous
times to which it ejected Hatter from his seat. The vehicle then came to rest
alongside the roadway where the other occupants were able to get out of the
vehicle.
The investigation into this incident is still ongoing
and updates will be made once they are available.

Information:
Sheriff Dale R. Gribler is requesting assistance
from the community in trying to locate a stolen trailer from the South Haven
area that was intended to be used on Saturday’s South Haven Area Blueberry
Festival to honor the Blueberry Court of South Haven.
On 08/11/2010, Deputies took a report of a stolen
trailer from a residence in the 72,000 Block of M43 Hwy located in South Haven
Township. Through an investigation it was revealed that a blue colored Dodge
Ram Pickup Truck with three occupants was seen pulling the trailer from the
front yard of a residence and last seen eastbound on M43 Hwy from the Scene.
Sheriff Gribler and deputies are asking for assistance
in locating this trailer and the possible suspects responsible for the crime.
The trailer was to be intended for use upon Saturday 08/14/2010 during the
Parade in South Haven to honor the Blueberry Court of South Haven for the year
of 2010.

Information:
Sheriff Dale R. Gribler reports that deputies conducting sex offender
registration checks in the South Haven area have been investigating the
repeated failure to comply with the sex offender act by a suspect out of
South Haven.
Suspect is on probation for sex offender violations of
young children and has served time in Illinois and Michigan for sexual
crimes and sexual registration violations. Officers from the South
Haven Police Department located the suspect and detained him for the
South Haven Township Deputy for an interview into the sex offender
violation of failing to register. Suspect confirmed that he has
repeatedly failed to register as a sexual offender with the South Haven
Township Deputy and subsequently arrested and lodged at the Van Buren
County Jail.
The Van Buren County Sheriff’s Office continues to
enforce sexual offender laws and monitor sexual offenders in the
community and will remain diligent in the efforts to protect the
citizens of the county.

Marcos Rodriges Ochoa, 33 years old, resides in South Haven Twp

2009, Village of Lawrence.
Information: Sheriff Dale R. Gribler reports that Deputies
received information while taking a complaint that the above suspect was at a
residence on 75th Street in South Haven Township, shortly after midnight on
August 1, 2010.
Ochoa had warrants issued for Assault with a dangerous
weapon and Felony Firearm from the original incident in which the news release
8081-09
was put out on in October of 2009. Ochoa also had additional warrants for Child
Support out of Ottawa County, and Failing to Appear at a Friend of the Court
Child Support Hearing out of Van Buren County.
Deputies utilized the Emergency Services Unit in an
attempt to apprehend Ochoa who has been wanted and unable to be located since
the incident in October of 2009. Deputies were unable to locate Ochoa initially
after responding to the residence, but did finally locate him in a room
padlocked on the outside on the rear of the unattached garage at that
residence. Ochoa was taken into custody without incident and lodged on all the
warrants at the Van Buren County Jail.
Ochoa was arraigned today in 7th District Court and a
Preliminary Examination was set-up on the Felony charges for August 10th at 8:30
AM. Bond was set at $10,000 cash/surety. Ochoa was also arraigned on the
Friend of Court Charges in Van Buren County Circuit Court and was given 2 days
jail with credit for 2 days or purge $350.
Ochoa is being held on the Ottawa County charges and
will be transferred to Ottawa County by their officials at some time to be
arraigned there.

Act 328 of 1931
750.82 Felonious assault; violation of subsection (1) in weapon free school
zone; definitions.
Sec. 82.
(1) Except
as provided in subsection (2), a person who assaults another person with a gun,
revolver, pistol, knife, iron bar, club, brass knuckles, or other dangerous
weapon without intending to commit murder or to inflict great bodily harm less
than murder is guilty of a felony punishable by imprisonment for not more than 4
years or a fine of not more than $2,000.00, or both.
(2) A
person who violates subsection (1) in a weapon free school zone is guilty of a
felony punishable by 1 or more of the following:
(a) Imprisonment
for not more than 4 years.
(b)
Community service for not
more than 150 hours.
(c) A
fine of not more than $6,000.00.
(3)
As used in this section:
(a) “School”
means a public, private, denominational, or parochial school offering
developmental kindergarten, kindergarten, or any grade from 1 - 12.
(b)
“School property” means a
building, playing field, or property used for school purposes to impart
instruction to children or used for functions and events sponsored by a
school, except a building used primarily for adult education or college
extension courses.
(c)
“Weapon free school zone”
means school property and a vehicle used by a school to transport students to
or from school property.

THE MICHIGAN PENAL CODE (Excerpt)
Act 328 of 1931
750.227b Carrying or possessing firearm when committing or attempting to
commit felony; “law enforcement officer” defined.
Sec. 227b.
(1)
A
person who carries or has in his or her possession a firearm when he or she
commits or attempts to commit a felony, except a violation of section 223,
section 227, 227a or 230, is guilty of a felony, and shall be imprisoned for 2
years.
Upon a second conviction under this section, the person shall be
imprisoned for 5 years. Upon a third or subsequent conviction under this
subsection, the person shall be imprisoned for 10 years.
(2)
A term of imprisonment prescribed by this section is in addition to the sentence
imposed for the conviction of the felony or the attempt to commit the felony,
and shall be served consecutively with and preceding any term of imprisonment
imposed for the conviction of the felony or attempt to commit the felony.
(3)
A term of imprisonment imposed under this section shall not be suspended. The
person subject to the sentence mandated by this section is not eligible for
parole or probation during the mandatory term imposed pursuant to subsection
(1).
(4)
This section does not apply to a law enforcement officer who is authorized to
carry a firearm while in the official performance of his or her duties, and who
is in the performance of those duties. As used in this subsection, “law
enforcement officer” means a person who is regularly employed as a member of a
duly authorized police agency or other organization of the United States, this
state, or a city, county, township, or village of this state, and who is
responsible for the prevention and detection of crime and the enforcement of the
general criminal laws of this state.

Constitutionality: The double jeopardy protection against multiple punishment
for the same offense is a restriction on a court's ability to impose punishment
in excess of that intended by the Legislature, not a limit on the Legislature's

Narrative:
Sheriff Dale R Gribler reports that Van Buren
County Sheriff’s Deputies handled a stolen vehicle complaint from a South Haven
Township resident.
While investigating the complaint, it was discovered
that the vehicle had been stopped in Benton Harbor and one of the two suspects
had been arrested for possession of drugs, but was released pending lab results
on the drugs confiscated. The vehicle was impounded at the time.
The vehicle was then later reported stolen by the
owner, once he had discovered it missing. The owner was taken to the impound
lot, identified numerous items in the vehicle that were not his. Through
further investigation, it was discovered that the items were some of the items
stolen from a vehicle in Bangor Township.
The Van Buren County Prosecutor’s Office did authorize
warrants against both subjects for the stolen vehicle. Matthew Eide was
arrested yesterday afternoon, found hiding in his residence in Hartford
Township, and Mark Eide was arrested through the assistance of the Kalamazoo
County Sheriff’s Office this morning on the stolen vehicle charge. Additional
charges will be sought against both suspects for larceny from a motor vehicle in
the Bangor Township incident. Matthew Eide was also on State Probation for
Burglary, and a detainer was also placed on him.
Both suspects were arraigned in 7th District Court West
on the below charges. A preliminary examination was set for August 9, 2010 at
8:30 AM in 7th District Court West. Bond on both suspects was set at $50,000
Cash/Surety.

Dale Gribler reports that Deputies made a traffic stop on a white
Oldsmobile for driving left of center and
defective equipment.
Deputies contacted the driver who was seen
earlier in South Haven City and was
suspected of dealing narcotics. Deputies ran the driver through Central
Dispatch and found him to have a Suspended Drivers License. Deputies placed
the driver under arrest and when doing so located 17 pills of ecstasy in his pocket. The driver denied any
involvement with the pills and stated he found them in a local park.
The
driver was taken to the Van Buren County Jail, where he was lodged for PWID-Ecstasy
and Driving on a Suspended License.

Narrative:
Sheriff Dale R. Gribler reports that deputies assigned to patrol the South
Haven Township coastline and DNRE Critical Dune Areas observed a male subject
driving recklessly with his ORV and having a small child on the back.
Deputies asked the subject to stop, to which he fled
from the scene on his
ORV. The South Haven Township Contract Deputy located the suspect's ORV as it
was concealed behind a residence. When the deputy attempted to located the
suspect, he observed the suspect running back towards his ORV from the woods.
The deputy then gave chase on foot as the suspect attempted to get away. The
suspect attempted to get back to his ORV but was caught by the deputy prior to
being able to drive off. The subject then fought with the Deputy and had to
be tasered to be subdued and restrained.
The suspect then refused all
officers’ requests and was arrested on numerous charges including
(Resist/Oppose Police, OWI on an ORV, Child Endangerment, Recreational
Trespassing, No Helmet upon an ORV, No DNRE trail pass permit.)
The suspect
was then lodged at the VBCSO Jail on the offenses.

Narrative:
Sheriff Dale R. Gribler advises on 06/30/2010 at approximately 2315 hours, a Van
Buren County Sheriff's Office Deputy contracted to South Haven Township, while
on patrol observed two males near a closed business upon Blue Star Hwy and M43
located in South Haven Twp. Due to the time of day and the deputy's knowledge
the business was closed, he began to investigate why the subjects were near the
business.
The Deputy immediately recognized one subject through
previous contacts and knew that he was on probation. The other subject (Jackson)
involved initially provided a false name to the officer to conceal his identity,
knowing he had outstanding criminal arrest warrants. As the deputy investigated
the matter, the suspect with the outstanding warrants began to fight with the
deputy in which the suspect attempted to kick at the officer. A brief
altercation took place and the deputy used the tazer to help control the
subject until back up arrived and the subject could be arrested. The subject
resisted to avoid being arrested on the outstanding warrants.
He was lodged at the Van Buren County Jail on the above
charges.

750.135a Leaving child unattended in
vehicle; prohibition; violation; definitions.
Sec.
135a.
(1) A
person who is responsible for the care or welfare of a child shall not leave
that child unattended in a vehicle for a period of time that poses an
unreasonable risk of harm or injury to the child or under circumstances that
pose an unreasonable risk of harm or injury to the child.
(2) A
person who violates this section is guilty of a crime as follows:
(a)
Except as otherwise provided in subdivisions (b) to (d), the person is
guilty of a misdemeanor punishable by imprisonment for not more than 93 days
or a fine of not more than $500.00, or both.
(b) If the violation results in physical harm other than serious physical
harm to the child, the person is guilty of a misdemeanor punishable by
imprisonment for not more than 1 year or a fine of not more than $1,000.00,
or both.
(c) If the violation results in serious physical harm to the child, the
person is guilty of a felony punishable by imprisonment for not more than 10
years or a fine of not more than $5,000.00, or both.
(d) If the violation results in the death of the child, the person is guilty
of a felony punishable by imprisonment for not more than 15 years or a fine
of not more than $10,000.00, or both.
(3) As
used in this section:
(a)
"Child" means an individual less than 6 years of age.
(b) "Physical harm" and "serious physical harm" mean those terms as defined

Information:
Sheriff Dale R. Gribler reports the Van Buren County Sheriff's Office
Narcotics Unit were able to obtain 2 search warrants after conducting a 3
month long investigation into possible marijuana distribution.
Narcotics detectives were able to obtain and
execute a search warrant on one of the storage units. Inside the unit,
detectives located approximately 7 lbs of marijuana in a plastic tote,
packaging materials, and shipping labels with the suspects name and address.
Narcotics detectives set up surveillance on the residence
while other detectives obtained a second search warrant for the suspects
residence. While surveillance personnel were waiting for the search warrant,
a vehicle was observed leaving the residence and traveled to the storage
units. Narcotics detectives and Van Buren County Sheriffs Office marked units
conducted a traffic stop on the vehicle while at the storage units.
Detectives made contact with the driver of the vehicle who was the 31 year old
suspect, along with an additional passenger. A search of the vehicle was
conducted and approximately 4 more pounds of marijuana was located inside.
After obtaining the second search warrant, detectives
searched the 31 year old suspects residence-property. Detectives located an
additional 2 lbs of marijuana in a chicken coop. The marijuana was buried and
hidden in a large blue barrel of chicken feed. Also seized was a digital
scale and a rifle. Seized under the civil forfeiture laws was the 2000 Chevy
Suburban.
This incident remains under investigation. Once
completed, a copy of the report will be forwarded to the Van Buren County
Prosecutors office requesting charges of Possession with intent to deliver
marijuana.

Gribler reports that Deputies were dispatched to the parking lot of the
Coastal Crossings apartments in South Haven Township in reference to a child
being left inside of a vehicle unattended.
Upon arrival on scene, the child
had already been placed into the ambulance and was being treated medically
and was then taken to the South Haven Community Hospital. Further
investigation revealed that the child was actually less than 4 months old and
was left unattended inside of a car in the parking lot,
according to witnesses, from 7 or 8 in the morning until approximately 2:40
pm.
A witness heard a woman screaming when she realized that she had left the
baby inside of the car. The witness was able to give CPR to the baby, who
was reported to be not breathing upon taking her out of the vehicle. Witnesses
report that the baby was revived by the CPR that was administered. Police
and EMS arrived on scene shortly after.
Due to the high temperatures today,
the child was diagnosed with dehydration, heat exhaustion, and lethargy. The
child was transported to South Haven Community Hospital and then transferred
to Bronson Hospital. The Child is listed in stable condition at this time.
This is an open investigation and the report will be submitted to the Van
Buren County Prosecutors Office for charges.

Narrative:
Sheriff Dale R. Gribler reports that Deputies were dispatched to 14th Avenue
between Blue Star Highway and M-140 for a personal injury snowmobile crash.
Upon arrival Deputies found a female lying in the
roadway near the Van Buren Trail. It was determined that the female was riding
with two other subjects. All three were heading westbound on 14th Avenue. The
lead snowmobile turned northbound on to the Van Buren Trail. The female, who
was riding second in the group, stopped prior to turning on to the trail and was
struck from behind by the third snowmobile in the group. The collision threw
the female from the snowmobile after being struck. The other drivers were not
injured in the crash.
Emergency personnel were hindered in their attempts to
get to the accident due to the depth of snow on 14th Avenue. Deputies located
an MDOT plow truck nearby and the truck was able to clear a path for emergency
vehicles to get to the patient.
Weather conditions and speed appear to be factors in
the crash.

Information::
Sheriff Dale R. Gribler reports that deputies received two separate reports of
home invasions in the Township of South Haven during the last two weeks of
July of 2009.
Deputies learned that a suspect had forced his way into
two secured residences and had stolen various items from inside the homes.
Deputies began their investigation to develop a suspect and during a check of
the surrounding area, one was located.
While interviewing suspect Jeffrey Capio of South
Haven, he was found to be in possession of evidence linking him to the crimes
and was found to be released from prison from numerous previous home invasion
arrests and convictions.
Capio was later arrested for the crimes and is awaiting
trial for the offenses and was also violated on his parole status from
prison. Drugs appear to be a factor in both crimes.
The Van Buren County Prosecutor's Office is now taking
over the case and will prosecute.

Information:
Sheriff
Dale R Gribler reports that Deputies were called to assist South Haven Police
Department with a armed robbery at Little Caesars Pizza.
Reporting officer notes that, while assisting in this
investigation, a car jacking took place not far from the crime scene while
officers were reviewing security camera footage.
Deputies then met with victim, Dylan Ackers, who stated
to police that he was held at gun point while he was robbed of all the money
on his person and driven away from the scene in his own car. Akers then
realized that the suspect did not have a gun. Akers then attempted to subdue
the suspect by choking him out. Akers was able to regain possession of his
vehicle and his freedom but not before being punched in the face by the
suspect.
Akers then led police to the scene. South Haven police
K-9 then tracked the suspect to a apartment in the 400 block of Alyworth in
the City of South Haven. Officers were then able to identify and arrest the
suspect with help from the employees of Little Caesars and Dylan Akers.
Officers were able to recover a large sum of money taken in the incident and
also recovered a stolen Mini 14 semi auto rife stolen from a breaking and
entering of a residence that occurred earlier in the week in Covert Township.
The suspect is being held at the VanBuren County Jail waiting
arraignment on kidnapping, and armed robbery charges.

Narrative: Sheriff
Dale R. Gribler reports that Deputies were dispatched to the intersection of
County Road 689 and 8th Ave. in South Haven Township for a personal injury
crash.
Upon arrival, it was determined that the driver, a 57
year old Vandalia man, was traveling northbound on County Road 689 and failed to
stop at a stop sign. The vehicle then travelled through the “T” intersection
and into a large ditch.
Deputies on scene noted that the windshield was cracked
on the driver’s side, indicating that the driver of the vehicle was not wearing
a safety belt.
A half empty, half gallon bottle of Seagram’s Gin was
located on the front passenger seat of the vehicle. It is believed that the
driver of the vehicle was under the influence of alcohol at the time of the
accident. Once the lab results are received the report will be forwarded to the
Van Buren County Prosecutor’s Office for review.

Information: Sheriff Dale R. Gribler reports that on
10/30/2009 Deputies from the Van Buren County Sheriff's Office received a
complaint of a stolen handgun from a residence in South Haven Township
Michigan. The handgun stolen was described as a vintage H&R style
revolver with an early date of manufacturer.
Deputies, at this time, began
their investigation and were able to develop suspects that might be affiliated
with the incident. During interviews with the suspects and through a lengthy
investigation, the handgun was recovered in the Pullman Michigan area.
Further interviews were conducted that placed two suspects directly involved
in the incident. One suspect was found to be the subject who stole the
handgun and attempted to sell it. The other suspect involved was found to
have concealed it in the attempt to sell the gun
in the South Haven area.
The subject, who was in possession of the handgun
when it was recovered and believed to have stolen it, was arrested and lodged
at the Van Buren County Jail on two separate felony charges
of Larceny of a Firearm and Possession of a firearm. This subject is
also on probation in Allegan County for an unrelated charge.
Additional
charges are being sought on both suspects through the Prosecutors Office.
Further investigation is still pending.

45 year old male South Haven area resident. Currently lodged at the Van Buren

90 Dodge Caravan, Damaged in the rollover crash.
Charges:
Felony Operating while intoxicated 3rd or subsequent offense, Possession of Open

operating while intoxicated arrests.)
Injuries:
The 45 year old male sustained minor injuries in the crash.
Narrative:
Officers were dispatched to the area of Baseline Road and 71 1/2th St located in
South Haven Township in reference to a single vehicle personal injury crash.
Upon arrival, Officers located a single van rolled upon
its side and the driver trapped inside the vehicle. After providing medical
attention to the suspect, and extricating him from the vehicle, he was taken to
South Haven Community Hospital for an evaluation. It appears that the suspect
while driving West on Baseline Road traversed across the center line and then
down into an embankment on the South side of the roadway where the vehicle
rolled and struck a tree.
While attending to the patient open alcohol was found
inside the vehicle. A subsequent investigation found that the suspect was
highly intoxicated and was driving a vehicle while his license is denied and
revoked from numerous operating while intoxicated arrests. The suspect is also
out on bond in Allegan County from another operating while intoxicated arrest
which occurred less than one month ago.
The suspect does have an extensive criminal history and
after being medically cleared was taken to and lodged at the Van Buren County
Jail for various offenses. A bond will be set in the Van Buren Case at a later
date due to the situation and felony charges. At this time, the situation is
still open pending possible charges against the vehicle's owner for allowing the
suspect to continually drive intoxicated and upon a revoked license.

the Van Buren County Sheriff’s Marine Division was on patrol on the Black River
South Haven Township, on Sunday July 5, 2009 at approximately 10:00 pm. Marine
Deputies made contact with Mr. Chambers while he was operating a pleasure boat
with eleven additional passengers in the evening hours on the Black River.
Marine Deputies found Mr. Chambers to be under the influence of alcohol. Mr.
Chambers was subsequently arrested for Operating While Intoxicated and lodged at
the Van Buren County Jail pending arraignment. Marine Deputies turned the
vessel over to a sober passenger and it was taken back to the dock safely.
The investigation has been turned over to the Van Buren
County Prosecutor’s Office.

Dale Gribler reports that on Sunday, July 5, 2009 at approximately 11:00pm,
Deputies were dispatched to the 71000 block of CR 388, South Haven
Township for a motorcycle versus car personal injury accident. Deputies found
that the driver of the motorcycle attempted to pass a line of cars after the
South Haven fireworks and collided with a vehicle making a left turn into a
private drive. A passenger on the motorcycle, Ariel Anderson, was thrown from
the motorcycle and received numerous internal injuries. Anderson was
transported to South Haven Hospital and then transferred to Bronson Hospital.
This accident is open pending further investigation.
